National Property Appraisal Group (NPA-Group)

These Terms & Conditions (“Terms”) govern access to and use of the website located at www.NPA-Group.com (“Website”) and any services provided by National Property Appraisal Group (“NPA-Group,” “Company,” “we,” or “us”). By accessing or using this Website, you agree to be bound by these Terms.


1. Permitted Use

This Website is provided solely for real estate appraisal–related business purposes. Any other use is prohibited.

You agree to comply with all applicable local, state, and federal laws, including Texas law.


2. Third-Party Technology (a la mode / ALM)

NPA-Group may utilize third-party appraisal software and services provided by a la mode technologies, LLC (“ALM”). Use of ALM services is governed by ALM’s terms, available at www.alamode.com/terms-of-use.

NPA-Group is not responsible for ALM system availability, outages, data transmission issues, or security incidents attributable to ALM.


3. Intellectual Property

All content on this Website—including text, graphics, layout, logos, images, and design—is owned by NPA-Group or its licensors and is protected by U.S. and international copyright laws.

You may not copy, scrape, frame, harvest, reproduce, distribute, or create derivative works from this Website without express written consent from NPA-Group.


4. Prohibited Conduct

You agree not to:

  • Scrape, mine, or harvest data or user information

  • Upload unlawful, defamatory, obscene, or infringing material

  • Impersonate any person or entity

  • Interfere with Website security, servers, or networks

  • Use bots, spiders, or automated tools without authorization

  • Solicit individuals or companies listed on this Website

  • Introduce malware, viruses, or destructive code

  • Use the Website for illegal or unauthorized purposes

Violations may result in immediate termination of access and legal action.


5. Payment Timing, Non-Contingency, Interest & Collection

Payment for appraisal services is earned, due, and payable regardless of loan approval, underwriting outcome, contract cancellation, value conclusion, or transaction closing.

Payment Requirements

  • Payment is due prior to inspection, unless otherwise agreed in writing.

  • If payment is made by cash or check, payment is due at the time of inspection.

  • If NPA-Group conducts an inspection before payment is received and fully cleared, no appraisal analysis, report development, or delivery will begin until payment clears.

  • Any delay in payment automatically extends all delivery timelines without penalty to NPA-Group.

Accepted Forms of Payment

Accepted payment methods are:

  • Cash

  • Check

  • Wire Transfer

  • Zelle

Credit cards or other payment methods are accepted only by prior written agreement and may be subject to additional processing fees.

Non-Contingent Fee

The appraisal fee is not contingent upon:

  • Loan approval or denial

  • Underwriting or investor decisions

  • Contract termination

  • Borrower, agent, or lender dissatisfaction

Once an inspection has occurred, the appraisal fee is fully earned.

Late Payment, Interest & Collection

  • Any unpaid balance shall be deemed past due.

  • Past-due balances may accrue interest at 1.5% per month (18% annually) or the maximum rate allowed by Texas law, whichever is less, beginning 10 calendar days after the due date.

  • The client agrees to pay all reasonable costs of collection, including attorney’s fees, court costs, filing fees, and collection agency fees, to the extent permitted by Texas law.

  • NPA-Group may withhold report delivery, suspend services, or decline future assignments until all outstanding balances are paid in full.

No Lien Rights Created

The parties acknowledge that appraisal services are professional services and do not create mechanic’s or materialman’s lien rights under Texas law.

 

 


6. No Guaranteed Turn Times

Any stated delivery timelines are estimates only and not guarantees. NPA-Group shall not be liable for delays caused by payment issues, access issues, third parties, data availability, or market conditions.


7. Market Volatility

NPA-Group is not responsible for changes in market conditions, buyer or seller behavior, lending standards, or interest rates before or after the appraisal effective date.


8. SMS / Text Messaging Consent (TCPA-Compliant)

By providing your phone number, you provide express written consent for NPA-Group to send text messages for business purposes, including scheduling, inspection coordination, order updates, and status communications.

  • Message and data rates may apply

  • Message frequency may vary

  • You may opt out at any time by replying “STOP”

Consent to receive text messages is not required to obtain appraisal services.


9. Privacy

Personal information voluntarily submitted is used only for legitimate business purposes and in accordance with our Privacy Policy, which is incorporated herein by reference.


10. Website Security

You are prohibited from attempting to breach Website security, including unauthorized access, vulnerability testing, or service disruption. Violations may result in civil or criminal liability. NPA-Group will cooperate with law enforcement as required.


11. DISCLAIMER OF WARRANTIES

THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, NPA-GROUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

NPA-Group does not warrant uninterrupted service, error-free operation, or specific results.


12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NPA-GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA.

IN NO EVENT SHALL NPA-GROUP’S TOTAL LIABILITY EXCEED THE APPRAISAL FEE PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

Some jurisdictions may limit enforceability; in such cases, liability is limited to the greatest extent allowed by law.


13. Indemnification

You agree to indemnify, defend, and hold harmless NPA-Group, its owners, employees, contractors, and agents from any claims, damages, losses, or expenses arising from your use of the Website or violation of these Terms.


14. USPAP Reliance Limitation

Nothing on this Website expands or modifies intended use or intended user as defined in any appraisal report. Reliance is limited strictly to the client and intended users identified in the appraisal, in accordance with USPAP.


15. PCI & Payment Data

NPA-Group does not store, process, or transmit cardholder data. You agree not to submit unredacted payment or credit card information in documents, emails, or uploads.


16. Governing Law & Venue

These Terms shall be governed by the laws of the State of Texas. Venue for any dispute shall lie exclusively in the county where NPA-Group’s principal office is located, unless otherwise required by law.


17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.


18. Attorney’s Fees

In any action to enforce these Terms, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs, to the extent permitted by Texas law.


19. Entire Agreement

These Terms constitute the entire agreement regarding Website use and supersede all prior communications.
